You agree that User Content will not violate the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights. You further agree that your Comments will not contain any libelous or otherwise unlawful, abusive, or obscene material, or contain any computer virus or other malware that may adversely affect the operation of the Service or any related website. You are solely responsible for your comments and their accuracy. We assume no responsibility or liability for any comments posted by you or any third party.

You are solely responsible for all of your User Content. Tagged Media. The Site extracts content from our users and customers who share photos and videos on Instagram, Facebook, Snapchat, Twitter or other social media accounts ("Social Media") using hashtags, mentions or otherwise posting about the Service. You acknowledge and agree that the Tagged Media may be used at RAYSTUDIO retail locations, in emails, on our website or on other websites/accounts that we operate or control, and you hereby grant us permission to use and authorize others to use your name or Social Media handle in connection with the Tagged Media for identification, Service related publicity and other similar promotional purposes, even after you terminate your account or use of the Service. You represent and warrant that the posting and use of your Tagged Media, including your name, likeness, voice or photograph, does not violate, misappropriate or infringe upon the rights of any third party, including, but not limited to, rights of privacy, publicity, copyright, trademark or other intellectual property rights.

 

Copyright Policy. RAYSTUDIO respects the intellectual property rights of others and expects its users to do the same. RAYSTUDIO has the right to terminate the privileges of users who repeatedly infringe, or are believed to be repeatedly infringing, the rights of copyright owners. If you are a copyright owner and believe that content posted on the Site infringes your copyright, please provide us with the following written information in accordance with the Copyright Law of the People's Republic of China

You also agree to indemnify us for any losses, damages or costs, including reasonable attorneys' fees, resulting from your use of any software robot, spider, crawler, or similar data gathering and extraction tool, or any other action you take that imposes an unreasonable burden or load on our infrastructure.

 

SEVERABILITY 

If any provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severable from these Terms of Use, and such determination shall not affect the validity and enforceability of any remaining provisions. 

 

TERMINATION 

The obligations and liabilities of the parties that arose prior to the termination date shall survive the termination of this Agreement for all purposes.

Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

Any ambiguity in the interpretation of these Terms of Service shall be construed against the drafting party.

DISPUTES

The competent courts of Hangzhou, People's Republic of China shall have exclusive jurisdiction over any claim or dispute arising out of or in connection with these Terms of Service and any documents referred to herein or the relationship between the parties.
